If you are thinking about investing in Spain before you consider signing any documents or paying any money in connection with the purchase of a property in Spain you should appoint a Spanish lawyer (“Abogado”) to represent you.
Searching for a home in Spain or settling your business is not more difficult than in the UK although your are likely to face additional challenges such as the language and legal tax concepts, most of them foreign to the UK system.
If you live in England, ideally your Spanish “Abogado” should be in the UK too, as he or she will be able to provide you with advice in English, during normal UK business hours, but in the other hand it is essential that your Spanish “Abogado” is experienced in Spanish legal matters and he or she should be registered with the Law Society as a Registered Spanish Lawyer. The Law Society will then regulate his or her practising and any work undertaken will be covered by professional indemnity insurance.
It is best to employ a lawyer who has been recommended to you by a friend who stands nothing to gain as a result of you instructing that lawyer. This should ensure that your lawyer is INDEPENDENT.
Every transaction must be considered taking into account the particular circumstances and the will of the parties. Bilingual skills, some legal knowledge and a good understanding of both parties intention are crucial..
